Free consignment agreement template
Fill in your store’s terms and the agreement updates as you go. Print it or save it as a PDF for each consignor to sign.
This is a starting point, not legal advice. Consignment rules differ by state, so have a local attorney check it before you use it.
The clauses stores most often get wrong
Paying before the return window closes
If you pay a consignor for a sale and the customer returns the item a week later, you have to get the money back. Holding each sale until your return window has passed avoids that.
Leaving unsold items open-ended
Without a pick-up deadline and a stated outcome, unclaimed items pile up in the back room and it’s unclear whether you may donate or sell them. Write both into the agreement.
Picking a percent when a flat fee fits
A percent pays the store well on expensive pieces and very little on a $4 paperback. Stores selling low-priced goods often charge a flat fee per item instead.
Not saying what a markdown does to the split
If prices drop on a schedule, say that the consignor’s share is worked out on the reduced price. Otherwise a consignor may expect their share of the original price.
Where Consignia fits
The agreement sets the terms, and someone still has to apply them to every sale. Consignia applies the split you set for each consignor to every Clover or Square sale, runs your markdown schedule and pick-up list, and holds each sale for your return window before it’s paid out. See the Clover consignment app or the Square consignment app, or try your numbers in the split calculator.
Consignment agreement questions
Something else? Ask us.
Do I need a written consignment agreement?
You should have one. A signed agreement records who owns each item, what the store keeps and what happens to items that don’t sell, so both sides have the same record to check when a question comes up. Some states have their own rules for consignment, so check yours.
What split is common for consignment?
There’s no standard. It depends on what you sell, your prices and what it costs you to sell it. Stores with low-priced goods often charge a flat fee per item, and antique malls usually charge booth rent with a smaller commission. The split calculator shows what each option pays on a real sale.
Can I change the terms later?
Yes, if both sides agree in writing, which is what this template says. Applying new terms only to items received after the change keeps things clear for items already on the floor.
Does a consignor need to sign each item list?
It’s good practice. The agreement sets the terms, and the item list records which items and prices both sides agreed. Have the consignor sign or initial a new list each time they bring items in.
Can I use this template as it is?
Treat it as a starting point. Rules on consignment, unclaimed property and sales tax vary by state, so have a local attorney review it before you use it with consignors.
